DoT sends an SOS to the Law Ministry for Sistema case

The Department of Telecom is anticipating legal action by Sistema and has therefore sent an SOS to the Law Ministry to create a team of lawyers to fight the possible arbitration. The Russian company Sistema had asked the licence cancellation issue to be settled by August 28.
The Indian authorities were not able to settle their concerns by that date.
The Russian company Sistema had earlier said it would be going to the international court for cancelling the mobile telephony licenses held by its Indian JV arm Sistema Shyam. The licenses of Sistema Shyam were cancelled by Supreme Court. The company had protested the decision saying it had taken the CDMA spectrum instead of the GSM spectrum hence its licenses should have been treated differently.
At the time when the scam happened, there was huge demand for the 2G spectrum and it was alleged the first-come-first-served policy was used to favour some companies. Sistema was the only company which wanted to get the CDMA spectrum. The company has also asked the Indian government to refer to the Indo-Russian bilateral treaty and wants its Indian investments to be protected.
