TDSAT adjourns Hathway, Taj Television matter to Tuesday

The Telecom Disputes Settlement and Appellate Tribunal (TDSAT) has adjourned the matter of Hathway Cable & Datacom versus Star India, Star Sports and Taj Television to Tuesday, 26 August.
The hearing in the matter began today with Hathway arguing that it cannot be made to pay the outstanding dues based on RIO rates retrospectively as the previous agreement was negotiated. The new agreement, in contrast, is based on RIO. The cable TV service provider argued that the outstanding payment should be made based on the rates as per the expired agreement.
The tribunal heard the Taj Television-Hathway matter and has adjourned it for tomorrow. If time permits, the tribunal might hear the Star India-Hathway matter as well.
The tribunal had in an interim arrangement asked Hathway to pay at the monthly rate of Rs 23 on a cost-per-subscriber basis for Star’s entertainment channels for digital addressable system (DAS) Phase I and II areas.
In case of Taj Television, it had asked Hathway to clear the broadcasters’ outstanding dues at the rate of Rs 21.60 per subscriber for the period April to July, subject to adjustments at a later stage. This would include the Zee (excluding sports) and Turner group of channels.
Piqued by regular squabbles, the TDSAT had listed Hathway versus Star India, Star Sports and Taj Television matters for 25 August as the date for final disposal of these cases. The tribunal had said that the final disposal of these cases at an early date is in the larger interest of all the parties.
