Ad cap: Kalaignar TV gets HC relief against TRAI’s coercive action

DMK-owned Tamil entertainment channel Kalaignar TV has joined the News Broadcasters Association (NBA), independent music channels and Sun TV Network in getting relief from the Delhi High Court against any coercive action by the Telecom Regulatory Authority of India (TRAI) in the 12-minute ad cap case. 
Earlier, in December last year, the NBA, music broadcasters (9XM, Mastiii, B4U Music and MTunes), E24 and Sun TV Network had moved the HC and got a similar order till 13 March after the Telecom Disputes Settlement and Appellate Tribunal (TDSAT) dismissed their case following a Supreme Court order. 

After hearing Kalaignar TV’s petition, the HC bench headed by Chief Justice NV Ramana gave the order, adding that the broadcaster will have to submit weekly reports stating their ad duration schedule to the TRAI as per the prescribed format. 
Prior to resorting to the Delhi HC, the channels had moved the TDSAT. After hearing the case and arguments from all parties involved, the Supreme Court had ruled that the TDSAT had no jurisdiction over regulation framed by TRAI and that power remained with the high courts. 
As per TRAI’s regulation on the quality of service, TV channels cannot show more than 12 minutes of ad in an hour.
