Court to take up plea against channels today

Shano, a person from Angamaly, has approached the Judicial First Class Magistrate Court 2, Aluva, seeking action against the woman who secretly videotaped sexual acts allegedly with Jose Thettayil, MLA, and allowed the visuals to be aired through TV channels. The case has been posted for Monday.
In his complaint before the court, Mr. Shano said beaming the visuals of the sexual acts was in violation of Sections 66 E (punishment for violation of privacy), 67 (punishment for publishing or transmitting obscene material in electronic form) and 67 A (punishment for publishing or transmitting of material containing sexually explicit act, etc. in electronic form) of the Information Technology Act, 2000, and Section 292 (sale of obscene books, etc.) of the IPC.

Several television channels beamed the visuals on June 23 following a complaint filed by her against the legislator and his son.
As the beaming of the visuals amounted to violation of the law, the role of the media in airing them should be probed. Computers and accessories used for the broadcast should be impounded.
The complainant contended that the woman recorded the sexual act using a web camera with the malicious intention of causing a grave social impact.
She shared the visuals with TV channels for furthering her vested interests. She had made these facts known in the petition filed before the police.
She was aware of the fact that the visuals were aired by the channels and were circulated on the Internet.
