DoT files plea against Tribunal ruling on Qualcomm

The Department of Telecom has filed a plea in the High Court challenging the telecom tribunal’s decision to set aside a penalty on Qualcom.
The DoT had reduced the validity of broadband spectrum to 18 years and six months from 20 years on allegations that Qualcomm did not comply with the eligibility conditions as specified in the auction tender document.

Qualcomm had participated in broadband spectrum auctions in 2010 and won four circles, Delhi, Mumbai, Kerala & Haryana. But the DoT held back the spectrum allocation saying that the company had not applied within the prescribed timeframe of 3 months.
Qualcomm took the matter to the telecom tribunal that quashed the DoT position. Meanwhile, the DoT raised a demand on Qualcomm’s joint venture partner Tulip for Rs 410 crore. This was contested by Tulip but since this was further delaying the licence, Qualcomm offered to clear Tulip’s dues.
Then TDSAT issued the final order in which it said that DoT will have to issue Qualcomm licence within seven days of payment of Rs 410 crore. The tribunal also said that the DoT will have to refund money back in case not found due, within four weeks after completion of Tulip’s assessment.
However more than a year has elapsed, and the DoT has not reassessed Tulip’s taxes as per TDSAT’s judgment.
