Delhi High Court issues notice to Star India on copyright infringement

The Delhi High Court has issued notice to Star India, producers Babble Fish, and sponsors Bacardi on a petition by the company Open Mind and music and writer musician Manish Kumar alleging that Star India Pvt Ltd has infringed its copyright by telecasting the programme 'The Dewarists' on Star World'.
Justice Manmohan Singh today asked the defendants to reply within 10 days and posted the matter to 19 December. The Court said that the order to stay the telecast will be subject to the outcome of the suit.

Kumar has alleged that he is the author, first owner, true originator, and lawful proprietor of a literary work about a concept and idea of the programmed format, wherein various national and international artists/musicians collaborate, travel and make music which finally concludes into a music video. The concept of the programme was put on its website www.spiritofmusic.in in November 2009.
Kumar also said that he had got the programme 'Music Virasat' registered with the Association of Motion Picture and TV Producers. It initially entered into an agreement with ETV for this programme and even began shooting but had to abandon the programme due to the Telengana agitation.
Thereafter, this programme was offered to Doordarshan which approved it. Later Kumar also submitted the script and idea to Channel [V] owned by Star India and a meeting was also held in June this year between the two parties.
There was no response thereafter from Channel [V] but the petitioner says he was surprised to see the programme being aired as 'The Dewarists' on 12 October this year.
A letter was sent to Star India, which said the programme's director would discuss the issue with the petitioner, but no such meeting was held. The petitioner has also approached the film bodies AMTPP and Film Writers Association.
