2 complaints against Kalanithi Maran quashed

The Madras High Court on 7 January 2013 quashed two complaints registered by the Central Crime Branch, Egmore, here last year against Kalanithi Maran, chairman, Sun TV and Sun Pictures, and three others.

Justice A. Arumughaswamy passed the order on petitions filed by the four seeking to call for the records relating to the proceedings in the two cases and quash the same.

Allowing the petitions, Mr. Justice Arumughaswamy said that one complaint against the accused for return of the balance sum of Rs.2.75 crore payable to the complainant, Sakthi Chidambaram, regarding the satellite rights of ‘Kavalan’ movie for which a civil suit filed by Sun TV Network was pending before the High Court.

The next complaint was the return of Rs. 4 crore paid by the complainant to the accused regarding the distribution rights of ‘Enthiran’ movie for Chengalpattu area. Whereas, a similar complaint had been given by the complainant against Hansraj Saxena, the executive of Blue Sky Cinemas, for the same relief.

Now again, the complainant had come forward with the second complaint against the petitioners for the same relief of refund of Rs. 4 crore under the false hope of political changes.

The other complaint, filed by one Naresh Babu, against the accused was for the return of Rs.25 lakh alleged to have been given by him for distribution and screening of the film ‘Vettaikaran’ in his cinema hall.

There was no documentary evidence to substantiate the said payment. Under such circumstances, the Judge said, he was of the view that all these aspects could be decided only by a civil forum. It could not be considered by way of criminal proceedings.
