SS TV @ S S Music Banned for 7 days

According to a press release from the I&B Ministry, SS Music channel renamed as SS TV from the South has been suspended for 7 days from 15th February to 22 February. Transmission or retransmission of the channel on any platform, including DTH, Cable TV, IPTV etc. throughout India is no permitted during these days.
The Central Government has passed this order in pursuance of the Order dt. 28.11.2011 passed by the Division of the Hon’ble High Court of Judicature at Madras in the W.A.No.481 of 2011 and M.P. No. 1 of 2011, validating the suspension of SS Music Channel (now christened “SS TV” Channel) and directing for a fresh period of suspension. Fresh dates for suspension of “SS TV” Channel have now been declared by the Ministry for 7 days from 12.00 midnight on 15th February, 2012 till 12.00 midnight on 22nd February, 2012.

In exercise of the powers conferred on the Central Government by Section 20(2) of the Cable Television Networks (Regulation) Act, 1995, I&B Ministry had issued an Order on 16.11.2010, prohibiting transmission or re-transmission of SS Music Channel on any platform throughout India with effect from 12.00 midnight on 22.11.2010 till 12.00 midnight on 29.11.2010. In view of telecast of a programme ‘Sizzling Hits’ on 25.03.2010 and 10.4.2010 in violation of the Programme Code contained under the Cable Television Networks Rules, 1994.
However, SS Music channel had filed a Writ Petition No.26197 of 2010 in the Hon’ble High Court of Judicature at Madras, challenging the aforesaid Order dt. 16.11.2010 issued by the Ministry.
The Learned Single Judge of the Hon’ble High Court of Judicature at Madras, passed an order on 19.11.2010, granting an interim stay on the aforesaid Order dt. 16.11.200 issued by this Ministry on 16.11.2010. Subsequently, the Learned Single Judge Bench of the Hon’ble High Court of Judicature at Madras, passed an order on 7.12.2010 allowing the aforesaid Writ Petition filed by SS Music Channel and set aside the Order dt. 16.11.2010 passed by this Ministry.
This Ministry filed an appeal against the Order dt. 7.12.2010 passed by the Learned Singe Judge before the Division Bench of the Hon’ble High Court of Judicature at Madras vide Writ Appeal No. 481 of 2011. Whereas the Division Bench vide its Order dt. 21.3.2011 was pleased to admit the Appeal and allowed interim stay as prayed for.
The Division Bench of the Hon’ble High Court of Judicature at Madras vide order passed on 28.11.2011 has allowed the Writ Appeal and has set aside the order passed by the learned single judge. The Hon’ble Court has also dismissed the WP No.26197 to 2010 filed by the Channel and directed the Ministry to give fresh dates of suspension.
In the meanwhile, the name of the TV channel has been permitted by this Ministry to be changed from “SS Music” to “SS TV”
