Licensing of DTH Dealers in UP legal: Allahabad HC

The bench of Justice Sunil Aambavani and Justice Kaashinath Pandey of the Allahabad High Court has declared the UP state government’s notification levying license fee on Cable Networks and DTH Dealers (TV Receiver Agencies) as legal, rejecting the petition by Sharad Traders of Gazipur.
The new amended law makes it necessary for the cable operators and TV Reciever Agencies to acquire license for providing their services.

The High Court has said that the state government has full right to make laws on the entertainment.
It may be recalled that Cable Quest reported in May 2011 (See Cable Quest Archives) issue that UP state government had levied license fee on cable operators, video cinemas and DTH Dealers (TV Signal Receiver Agencies) amending the Uttar Pradesh Cinemas (Regulation) Act, 1955 through a Notification.
A dealer of DTH services, Sharad Traders of Gazipur had appealed against the Notification in the Allahabad High Court.
